    I freeeeeking can't believe this!!!

    "Damerville said Hawai'i law makes it difficult to prove a motorist who has been using cocaine is actually impaired. Some states have laws declaring that a motorist is automatically deemed to be impaired if the person has been using cocaine, but it's not the case in Hawai'i, he said."

      Interesting. Would a person high on cocaine pass a field sobriety test? How else would you determine drug impairment at the scene, short of a blood sample sent to a lab?

          What makes this particular story even worse is the guy who got caught driving under the influence of coke is a well-respected kumu hula in Hilo. THIS is the kind of role model we want for our keiki? How can we expect our keiki to grow up to be decent law-abiding citizens when the adults they are supposed to respect get caught doing things like taking illegal drugs or sexually preying on young people?

              Cocaine, crack, meth et al, make no distinctions for social status. Fame, fortune, and not to mention brains in the literal sense, have all been lost for countless people who just that one time said, "Ahh I going chance um just this once to see how it feels." That's all it takes for some people, just that one time, and they're no longer in control of their lives. The Devil's now in the driver's seat and they're just along for the ride...to hell.

                six months in jail plus probation? for behavior that took another man's life. silly me. i didn't realize life was so cheap here. what a wonderful judicial system we have.

                  the more ya read that article the more fupped uck da system appears to be.
                  Further, Ray was avoiding potholes. so he drove english style left side. Pot killed da guy, not Cocaine.
                  Oh, and da odda guy was "on a medication" too!

                    One major lesson to be learned from this fiasco: If you're going to play chicken on a pothole plagued road, make sure you're the one who's enclosed in the cocoon of steel and not the one who's on two wheels.

                      That's just it. How do you know he was under the influence? He could have used the day before, and it would have still shown up on a blood test.

                        That doesn't mean he's off the hook. He still ingested an illegal substance.

                          I agree. And he didn't walk out of court with a not guilty verdict. He deserves some jail time for what happened.

                          Just don't say he was under the influence. Unless there was some sort of field sobriety test that he failed, it's unfair to judge him that way.

                            For all we know, some people would be better drivers on coke. It does make you more alert and aware. So I hear. Not like alcohol, which numbs your senses.

                            Before people get hysterical about someone driving under the influence of a particular drug, perhaps they should research how that drug actually affects performance. You know, there's a reason they call certain substances "performance-enhancing drugs."

                            Drugs like caffeine and cocaine have been shown to increase performance of certain tasks ... but definitely not others (right guys?).

                            Meanwhile, all kinds of folks are driving around under the influence of cold medicine, allergy medication and other meds that actually REDUCE their reaction time. But people think that's OK because they're legal.

                            I'd rather be in a car with someone who just did a line than someone who just took a couple of Benadryl. But don't confuse people with facts -- it's so much easier to assume that if a drug is illegal, it must be bad.

                              Do you think if the driver hadn't been a well known kumu
                              that we'd be discussing whether he was or wasn't under the
                              influence? Let's say he was a hawaiian man driving home to Kau but he's unemployed, borrowed car, no visible contribution to society in terms
                              of what Ray Fonseca has accomplished. He causes a head on collision
                              with the guy on the bike, no other cars in sight. What would the majority
                              of us be talking about then? Probably not this case.
