  • Seeking Hawaii Photos

which photo company online (downloadable) do you recommend for good Hawaii photos only?.

I tried 5 stockphoto sites and they don't have any local people on any of the photos. Some get plastic flowers and a model in bikini ... what's up with dat?. we locals like to stay away from fake stuff and this is why I come and ask.

    Please kokua.

[DISCLAIMER: I'm not a lawyer. This isn't legal advice. If you're in doubt, you should hire a lawyer. Don't sue me. Blah, blah, blah.]

My guess as to why you don't see many pictures with people in them are legal reasons. Even though the photographer owns the photo, they don't have the right to make money off of it, if a person in it is recognizable. To do so, the photographer would need to obtain a model release from everyone in the picture. That's why you see some TV commercials where people's faces are blurred out.

Furthermore, if the model release doesn't allow the photographer to transfer commercial rights to you, after you buy the photo you will also have to hunt down the people in the picture and get them to sign off, if you want to use it for commercial purposes yourself.

You can try the Creative Commons section of Flickr. They have a variety of licensing agreements (some simply require you to give credit to the photographer). Here's a search of "hawaii beach people":

Of course, even though the photographer is allowing you to use their picture, you'll never get a model release from the people in it, so be careful about how you use it.
