  • Data on Car Crashes Cannot be Released

    According to HDOT they cannot publically release data on car crashes
    relating on the highways. This despite a US Supreme Court ruling in 2003
    that data cannot be used against the states in any litigation. Other
    states like Iowa post this data freely available on online.

    Evidently the US Supreme Court ruling does not apply to Hawaii as far as
    I found out. What doesn't make sense to me is that I thought all US
    Supreme Court rulings applies to all 50 states.

      " The DOT refuses to release traffic accident statistics citing legal liability concerns despite a 2003 U.S. Supreme Court decision protecting states from the data being used as evidence in lawsuits."

      " A 2003 U.S. Supreme Court decision in Pierce County v. Guillen also ruled that data collected for use in the Highway Safety Improvement Program can't be used against states in court. Numerous states, such as Iowa, have subsequently made traffic accident statistics available to the public through the Internet."
