Hey, since when did Talk Stink start doing cartoons? Funny stuff!

It's been about two weeks, and I just LOVE it. Hilarious and edgy. That second strip about Vili the Warrior had me rolling!
But I'm disturbed! I'm depressed! I'm inadequate! I GOT IT ALL! (George Costanza)

I think they've found their calling. The "Lost" blurbs and other written zingers are okay, I suppose, but something about the incorporation of comic-style drawings really works with the material. Finally, something beyond Pritchett and Corky (though both have their place).

Does reusing the Star Bulletin photos and photos from a pro photographer constitute copyright infringement on the part of TalkStink.com? Quoting something in this forum is one thing, but I would think taking someone's content (photos) and reusing it as part of your own work could open a pandora's box to litigation.

I think what they're doing probably falls under the "fair use" clause, so no problems.

Added: Specifically, I think it would be parody fair use.

I wonder. IANAL, but wouldn't the "parody" definition only apply if {x}'s use of {y}'s work is a parody or criticism of {y}'s work? That is, taking clips from Fox News to make fun of Fox News? This is repurposing, say, a Star-Bulletin photographer's work to make fun of Timmy Chang. Timmy Chang might not have a leg to stand on, but I'm not so sure that the photographer or source publication doesn't have standing. Nothing's stopping Talk Stink from securing its own images of Timmy Chang, for example... or just drawing him outright.

The intent is definitely commentary and criticism, and it's certainly transformative. On the other hand, the context can be said to be commercial, and it's not like the message can't be conveyed without the photographic elements (though that's certainly part of what I like about it!).

I just hope the creators of the source works have a good sense of humor...

If the lawyers are called, then you'll know who has a sense of humor.

Indeed. I'm working on conforming to fairer "fair use" guidelines.
