    Well, the Federales are at it again. Now the Dept. of Justice wants broader powers to investigate and prosecute instances of pirating. So all you kiddies who have been downloading music and movies for free...be careful. If the DOJ has its way, you, too could be hauled into the calaboose in the very near future.

    In my opinion there is a law already on the books that they could use
    to go after people sharing large quantities of copyrighted material.
    It is called the No Electronic Theft Act http://www.usdoj.gov/criminal/cybercrime/17-18red.htm
    In my opinion they should use existing laws to go after people doing
    this. Instead of adding more laws that will restrict law abiding people.

      Eh Aaron, dat's da point: dey like expand da law so going cover all da college kine kids and da "little fishies" too. Plus da feds really niele , you know? Dey like be able to wiretap anykine conversations you having and sniff any digital communications you might make (including cell phones and what you do online) and dey like do it without cause or subpoena. Remember "carnivore"? Dey gotta know everyting we doing. Pretty soon, you going need check wit da police before you can go use da lua .

        Is it illegal for a teacher to do that on a school campus?

        In 10th grade, I remembered my english teacher (who was cool) had a computer connected to the internet to get audio comedy clips and "foreign songs" that she liked to listen to in class.

        I didn't realize that until today. I forgot what service/network she used, but it was a popular one.
        How'd I get so white and nerdy?

          All that free kine stuff to download going go away. If you pay for each download, that's OK. The recording industry is all in favor of this bill. I wonder why??? The ones they really don't like are the people who download and save stuff and then pass it along to their friends, because that's lost revenue for the recording companies and the artists.

            Um. Only if you mean "free" Britney Spears or "free" Avril Lavigne. Fortunately, if you're willing to go even a little out of the mainstream, money-hungry music industry, you'll find a lot of good stuff that hardworking, talented artists are giving away... just in the hopes you'll like it, and buy their CD someday.

            One spot to try: Epitonic.com. And although MP3.com is hardly the hotbed of indie artists it used to be, it still serves up decent free music alongside the stuff it wants to sell. Here's a discussion of free music offerings on Metafilter.

            Even better, thanks to the power-to-the-people potential of blogs, a lot of folks have dedicated themselves to finding, reviewing, and recommending indie artists and their online offerings.

              If Bush gets re-elected thats what will happen what you mentioned.
              If you want your presonal privacy maintained, it is important to vote
              in the upcoming elections.

              I look at it this way, the content producers are money grubbers [It blows
              my mind one software application costs 3,000].But even if they are money
              grubbers it is not right to illegally pirate copyrighted material bottom line.

                  That's very true, Ryan. Unfortunately, most kids who use Gnutella or whatever aren't really interested in "artists of the future". They want Avril, Britney and whoever the artist du jour is. Now us old fogeys, we appreciate undiscovered talent, so getting free downloads from the indie sites would be OK for us.

                    I guess that's the good thing about being old, you either have virtually every song you like or you were akamai enough to have downloaded all the songs you like before the crap hit the fan. I saw the writing on the wall and got busy with my external hard drive and RR.

                    But I know it's wrong, I know it, I'll eventually sign up with those legit sites because I have such a guilty concious.

                    Regarding kids getting caught, remember the Feds will go after the parents or whomever is the customer that internet connection is tied to. So if your kids have networked computers in your home (as mine did) make sure you watch what they do. And that includes teen porn sites. My 17-year old in his limited common sense thought teen porn was porn for teens so he would go to these sites. Okay sounds like a fair arguement (to him). After a brief discussion on what it implied and the consequences of visiting these sites he realized he didn't want mom going to jail, you see the internet account was in her name. Yeah I know if it was under mine he would not only go back to the site but use my name as some 17-year old loser looking for a hot chick. Alright Dad's in jail no more one-hour lectures!

                      Well that is good advice Craig. It boils down to how you monitor your
                      childrens internet access. As we have seen the RIAA file suit against
                      the parents of the children illegally swapping music online. If I recall
                      correctly 5500 lawsuits have been filed to date.

                      In regards to the teen porn sites, it is good you spoke to your child
                      about going to those sites. As they are cracking down hard on
                      people viewing that smut.As if you get caught going to these sites
                      it could land you some hard time and brand you a sex offender for life.

                        I tell you it really boils down to how much you trust your kids because getting in and out of a porn site is as quick as a click.

                        For parents who have little rapport with their kids or the other way around, the kid will do whatever it takes to circumvent the rules of the house. My kids are pretty good so they stay out of trouble but once in a while you still gotta check up on them.

                        I heard it's so easy to bypass parental controls on an internet browser, you simply open another browser window while the other one is trapped by the locks, the other one is free to venture into the internet void uninhibited. My kid told me that one!

                          Yep, there is very little new music that interests me these days. I have most all of the older classic rock and pop music that I like. All that remains is to find those hard to get tracks that never got released on CD.... That said, half the fun is looking for these rare old tracks. I prefer to buy my music on CD, whether it be from Tower, Amazon.com or used from garage sales or at Jelly's. I usually just rip the tracks from my CDs to my Power Mac for use to make compilation CDs and just play through my Mac to my home stereo. I never was into music downloads mainly because most of the services (illegal or legal) only work with PCs....

                            Ashcroft Vows Piracy Assault

                            While the entertainment industry has had some recent setbacks in its fight against piracy in the courts and in Congress, it has a new ally in John Ashcroft, who recently pledged to make cracking down on copyright violators a top priority.

                            On Tuesday, the attorney general released a report from the Department of Justice's Intellectual Property Task Force that outlines plans to beef up enforcement of copyright violations.

                            "With the recommendations put forward by the task force, the department is prepared to build the strongest, most aggressive legal assault against intellectual property crime in our nation's history," Ashcroft said in a statement.

                            Those recommendations include increasing the number of FBI agents to sniff out copyright violators, better training programs for prosecutors and law enforcement officers who investigate such offenses, and increasing cooperation between businesses and individuals affected by such theft.

                            The report (.pdf) -- which covers copyrights, trade secrets, trademarks and patents -- also says that those who benefit most from this theft "are criminals, and alarmingly, criminal organizations with possible ties to terrorism."

                            Calling it "music to our ears," Mitch Bainwol, CEO of the Recording Industry Association of America, praised the Justice Department for making the prosecution of copyright violators a priority. "No administration has ever mounted such a comprehensive approach to defending America's gift to the world -- our creativity," Bainwol said in a statement.

                            The Motion Picture Association of America also applauded the recommendations.

                            The task force also lends its support to several pieces of copyright legislation. The Justice Department supports the Induce Act (SB2560), which would hold businesses liable for encouraging people to infringe copyright. It also supports the Piracy Deterrence and Education Act (HR4077), which would amend copyright law "to clarify that it may be a violation merely to offer copyright works in a digital format for others to copy," according to the report. The task force also endorsed the ART Act (SB1932), which makes it a felony to use a video recording device in a movie theater.

                            The task force opposes the Boucher Bill (HR107), however, when it states that "the circumvention of technological safeguards protecting copyright works should be subject to prosecution." The Boucher Bill would permit the sale of devices for fair-use purposes.

                            Extra enforcement help from the Justice Department is unnecessary, and should such recommendations be implemented, privacy will suffer, according to Jason Schultz, an attorney with the Electronic Frontier Foundation.
