        So, if Mesa says they have turned all the files over to Hawaiian now, does that include the porn? Will it show up as in-flight entertainment now? And which files will turn out to be the most offensive, in the long run?

          Seriously, if he co-mingled porn and competitor info, doesn't that strongly suggest that he knew it was stuff he shouldn't have? And if they have enough info to know he deleted the files, I'm sure they can figure out if there was any porn involved.

            Ah, yes. The old "I accidentally purged some critical company files as I was deleting my old porn downloads" defense. In most companies, having porn (or cruising for porn) on a work computer is grounds for termination. So which is worse: getting terminated for downloading porn or deleting critical files and possibly causing a company to go bankrupt? His defense stinks worse than 10 year old gorgonzola.

              Actually, this defense, while it sounds outrageous, is actually pretty cunning. Murnane may have been designated as the fall guy at this point. If files are deleted and wiped properly, there isn't anything you can do to find out what they were. You only know they were deleted files. So being fired and busted for viewing porn is a far smaller offense than if they were company sensitive files.

                Oh, he's definitely being singled out to fall on the sword for the company. Take a look at his list of credentials. Does anyone really think someone who's been an executive for as long as he has could be as stupid as his defense claims? I bet somebody will be slipping him a nice "retirement package" under the table for taking the rap for this one.

                I understand that someone may have copies of the deleted files.

                  Better hope there are copies because again, as funny or ridiculous as deleting porn off a work computer sounds, that sad fact actually happens in corporate America all the time. I've known managers fired for viewing porn on their PCs. So it may actually fly in court if these files can never be determined to be what they truly were, company data or porn? And since this is a civil lawsuit, you only need a slight preponderance to win.

                      Yeeha! And the judge ruled in favor of HA! I seriously doubt the judge will award HA the whole $173 million (which happens to be about 4x Mesa's profit last year), but it does show that some unscrupulous business practices were afoot. Now we'll have to wait for the AQ trial.

                        Mesa in deep kim chee. Hawaiian won today and have reportedly turned over Mesa and Ornstein to the SEC for Sarbanes Oxley violations. Talk about adding insult to injury. Mesa picked the wrong guys to start a fight with.

                            That blog is really interesting! I am reading his posts right now. There seems to be really good stuff from credible witnesses... None of which ended up in the newspapers. Hmmmm I wonder why?

                            During Jonathan Ornsteins testimony these notes were taken by individuals sitting in the courtroom.

                            I thought Hawaiian attorneys were right in making the point that there were potential Sarbanes-Oxley issues involving a recent Mesa press release. I had thought the same thing. According to the notes we received, this was the recent press release,
                            "in which, while stating that Mesa maintains the "highest ethical standards," Mesa fails to disclose to shareholders that Mesa's CFO –the person responsible for public shareholder reports – was facing allegations of destruction of evidence that he was federally-mandated to preserve. J.O. admitted that he had reviewed and approved this press release. J.O. got flustered here and blurted out that they had no responsibility to issue any information at all under NASDAQ rules.

                            Hawaiian then established that in spite of Mesa's 'highest ethical standards' they did nothing in the face of Judge Faris' ruling that Murnane had lied. Hawaiian attorneys then brilliantly confronted J.O. with the Wall Street Journal article in which J.O. stated that 'he took exception with the court's conclusions'. As 'the court' was Judge Faris -- the very man that J.O. was sitting in front of -- this caused a bit of squirming on the Mesa bench."
                            Thanks anon! that blog seems to be a good place to get my daily dose of REAL NEWS from the Hawaiian vs Mesa trial. Not the yellow journalism being presented by our worthless local newspapers.

                              well I think this went worse for Mesa than anybody (even myself) could have ever predicted.

                              While not one single apology to aloha-anon came in over the past few days, all of a sudden nobody is here defending Mesa either.

                              Thats OK, were not even at half time... & I promise much more sportsmanship over the next six months leading up to Mesa's end game in April.

                              Oh and I finally figured out what the "JO the Jew BORAT" remark meant on the infamous t-shirt. Google "In My Country There Is Problem" its an old school Ali G video.

                              I have been pissed off at Mesa for a long time and only finally got this joke. It must be another inside joke meant to chap at Ornsteins hide.

                                Have you guys heard anything about why Garfinkle settled his part of the suit? Both his company and HA say that that settlement (we don't know for how much) was favorable to them.
