  • No 'official' nude beaches, but topless okay!

Hawai'i has a great beach going / outdoor lifestyle though still kinda prudish.
Maybe leftovers from the missionary days? Many other countries and maybe States have nude beaches or topless.
No law in Hawaii bans women from going topless though rarely does anyone.
    Read this article... http://archives.starbulletin.com/200...kokualine.html

There are two Hawaii Revised Statutes:
HRS 707-734 "A person commits the offense of indecent exposure if the person intentionally exposes the person's genitals to a person to whom the person is not married under circumstances in which the actor's conduct is likely to cause affront."

HRS 712-1217 "A person commits the offense of open lewdness if in a public place the person does any lewd act which is likely to be observed by others who would be affronted or alarmed."

After a little research I found this:

Clothing Optional (aka Nude or Naturist) Beaches
Lots of places offer you lists of nude beaches. Some even provide directions. Here you will see where the beaches are on a map.

There are several criteria that must be met for a beach to be included here. It must be publicly accessible, as in not part of a private club. It must be legal, not someplace that says "cover if you see anyone to avoid a ticket". Sad to say that their criteria isn't always met since 'Little Makena' Maui and 'Secret Beach' Kauai are listed but not LEGAL.

World Beach List is currently up to 250 clothing optional beaches.

I vote each of the Hawaiian Islands should have at least one legal beach(or part of) for clothing optional usage!

Quite frankly, I find it discriminatory when a 'STATE' agency takes it upon themselves to dictate that women must cover their upper bodies when men are not subject to the same rule. GENDER discrimination!

If, however, a male or female desires to cover their upper body, that is their right.
However, if it is forced upon one gender, then it must be forced upon the other gender as well.

What's good for the goose is good for the gender.... Or something....

Taken from the article link in first post...
"There is no state or city law prohibiting women from baring their breasts in public, acknowledged Capt. Carlton Nishimura, of the Honolulu Police Department. He double-checked with the city Prosecutor's Office to make sure."

So women can go topless in Hawaii. I think it's not widely known though.

There used to be a nude beach on the north shore. No more?

Oahu has the biggest police force in Hawaii, so its beaches are the ones most likely to be patrolled to keep nudity at bay. It’s also the most populated and crowded of the islands, so your chances of finding a quiet and secluded beach on which to sunbathe in the buff are slim. Still, if you’ve gotta get naked, these are some beaches to try.

Polo Beach (Mokulea) – It’s on the popular North Shore, and is where many of the local nudists go, but it’s not always nudist-friendly. West of Wailua, toward Farrington Air Field.

Diamond Head Beach – There’s one area of this beach that’s unofficially gay-only, so if that suits you then give it a whirl.

Two other beaches mentioned on Oahu to try are Kahuku Beach (on Route 83, 2 miles north of Laie) and Kaneane Beach (off Hwy 93, on leeward shore).

            But again... all still illegal.

So I guess technically it is legal to go topless (both male and female) on any public street, public park, public beach, etc.

Wonder if it is legal to go topless in an airport? Would that make getting through the security check faster? Bet it would make it funner for the other passengers.

So, it's not a lewd act if a woman walks or run topless and their breasts just jiggle from such activity.

Would it be a lewd act if she intentionally wiggles them?

Well, since men muscle-builders can legally "wiggle" their pecs .... I suppose a woman could legally wiggle/jiggle her pecs.

When I was in the service, I put up a framed poster of a woman surfing topless with a caption that read "Surf Naked" in my dorm room. I was told to take it down because it was pornographic. When I looked up the definition of what Porn was, Webster's only indicated if it shows reproductive genitalia would it be considered porn. Breasts are not considered reproductive genitalia at all. I got to keep my poster up.

The points here that I want to make are...
One, yes I want to sunbathe and frolic with my wife naked on the beach.
(Will chance 'um when we go Kauai soon!)
Two, there are many, many others that wish to do so also.
Without fear of it being illegal.

Nude beaches, hot springs, and other public nudist locations from all over the world are being documented here.

                            Kauai Nude beaches:
There seem to be plenty of stories about the old Mayor, the new Mayor, the Law, and about changing conditions. Believe what you wish. One thing that is true is that Kauai has been discovered and there are plenty more visitors than even 5 years ago. This means that places once considered remote are now regularly visited by everyone. Enjoying a friendly nude beach has become more difficult and must be done with heightened discretion.
                            http://www.djhome.net/kauai/beaches/nudebeaches.htm

Anyways... I think this topic needs more serious discussion to bring out the fact that there's a difference between lewdness and nudity. What do you think?

i recall some part of canada it is legal for women to be topless in the city.. i think it was quebec. basically a womans group fought the law and won, based on the grounds that men go topless all the time.
so i say hooray; then i remember that not everyone has nice boobies so when you think nude beach dont forget you may see some boomin grannies there =D

when i was younger, we'd cut school and go by blackpoint - sometimes theres be topless women there, if we were lucky!
